DECISIONS ON SQUID INVESTIGATIONS

The Minister of Environmental Affairs and Tourism had considered 48 appeals in terms of Section 80 of the Marine Living Resources Act (Act No. 18 of 1998) ("the Act") regarding the Deputy Director General's ("the DDG") allocations in the squid sector.

Of these 48 appeals, the Minister had decided to reserve his decision in respect of the appeals of TI Barnard, Iqhayiya Fishing (Pty) and Umphunzi Fishing (Pty) Ltd pending investigation and requests for further information.

The Minister has now considered the further information and the report of the investigator and decided to reject the appeal of TI Barnard and grant rights to Iqhayiya Fishing (Pty) Ltd and Umphunzi Fishing (Pty) Ltd. This is apparent from Annexure A hereto. However, in order for the Minister to grant rights to the two appellants, the squid TAE had to be increased. This is apparent from Annexure B hereto.

The DDG compiled a report in respect of each appeal in terms of regulation 5(3), promulgated under the Act. Appellants are entitled to inspect these reports, and at the prescribed fee they may obtain copies of the reports from the Appeals Department, 4th Floor, Foretrust Building, Martin Hammerschlag Way, Foreshore, Cape Town, 8001. Appellants are also entitled to inspect the spreadsheet which records the Minister's decisions.

DECISIONS ON SQUID APPEALS

The Minister of Environmental Affairs and Tourism considered 48 appeals in terms of Section 80 of the Marine Living Resources Act (Act No. 18 of 1998) ("the Act") regarding the Deputy Director General's ("the DDG") allocations in the squid sector.

In the General Published Reasons, it was stated that 120 crew was reserved for successful appellants. This figure did not take into account that 41 of the 2266 crew allocated by him were restricted rights, that should be subtracted from the restricted TAE of 200, and not from the unrestricted TAE of 2386. In fact, 161 unrestricted and 159 restricted crew remained to be allocated on appeal.

On appeal, the Minister allocated 155 crew to successful appellants. No decisions have been made in respect of the appeals of TI Barnard, Iqhayiya Fishing (Pty) and Umphunzi Fishing (Pty) Ltd pending investigation and requests for further information.
